Participation in running/walking carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The risks range from minor injuries such as scratches, bruises, and sprains to major injuries such as broken bones, to catastrophic injuries including paralysis and death. By becoming a member of United In Stride the user understands understand and appreciates these and other risks that are inherent in this activity and fully assume the risks associated with walking, jogging, running and/or guiding.
The user agrees to assume all risk and responsibility of damage or injury that may occur to them in any activity facilitated by United in Stride. In consideration of registering for and using this website, the user, for themselves, their heirs, personal representatives or assigns, waive and release from any liability whatsoever the Massachusetts Association for the Blind and Visually Impaired, MAB Community Services, its officers, employees, and volunteers, the visually impaired walker, jogger, or runner (if I am the guide) or the guide (if I am the visually impaired walker, jogger, or runner) and agree not to sue any party for any property loss, damage, or bodily injury (including death), however caused, which may result from my participation in running as either a guide or visually impaired walker, jogger, or runner.
The user agrees to INDEMNIFY AND HOLD the Massachusetts Association for the Blind and Visually Impaired, MAB Community Services, its officers, employees, and volunteers, the visually impaired walker, jogger, or runner (if I am the guide) or the guide (if I am the visually impaired walker, jogger, or runner) from any and all claims, actions, suits, expenses, damages and liabilities brought as a result of my involvement in walking, jogging, running and/or guiding, and to reimburse them for any such expenses incurred.
By becoming a member the user has read the waiver of liability, assumption of risk, and indemnity agreement, fully understands its terms, and understands that they are giving up substantial rights, including their right to sue. The user acknowledges that they are signing the agreement freely and voluntarily, and intend by their membership to be a complete and unconditional release of all liability to the greatest extent allowed by law.
